The works council decides, the employer pays.

The works council may itself resolve to acquire the resources it needs for its work – and the employer bears the cost. This kit helps you demonstrate that Mandat is necessary and to formally push the acquisition through.

Establish necessity

Document why Mandat is necessary for your works council: quorum checks under Section 33, notice periods, prevention of formal errors and data sovereignty.

Pass a resolution (Section 33)

Put the acquisition on the agenda of a quorate meeting and pass a proper resolution. Use the model resolution for this.

Letter to the employer

Notify the employer of the resolution and set out the necessity. The supporting letter provides the legal reasoning.

If refused: conciliation board

If the employer refuses to cover the costs, the works council may call the conciliation board or take the matter to the labour court in resolution proceedings.
